Default has been made in the conditions of a mortgage made by Ruby Burton and Eli Burton, wife and husband, to Long Beach Mortgage Company, Mortgagee, dated April 15, 2003 and recorded August 26, 2003 in Liber 2420, Page 1825 Berrien County Records, Michigan. Said mortgage is now held by U.S. Bank National Association, As Trustee, Successor In Interest To Wachovia Bank, National Association, As Trustee For GSAMP Trust 2004-Sd1 Mortgage Pass-Through Certificates, Series 2004-SD1, by assignment. There is claimed to be due at the date hereof the sum of Thirty-Eight Thousand Seven Hundred Thirty-Nine and 93/100 Dollars ($38,739.93), including interest at 6.99% per annum.
Under the power of sale contained in said mortgage and the statute in such case made and provided, notice is hereby given that said mortgage will be foreclosed by a sale of the mortgaged premises, or some part of them, at public vendue at the place of holding the circuit court within Berrien County, Michigan at 10:00 AM on APRIL 18, 2019.
Said premises are located in the City of Benton Harbor, Berrien County Michigan, and are described as:
Part of the Northeast 1/4 of Section 19, Township 4 South, Range 18 West, described as follows: beginning at a point in the South line of Buss Avenue 346.64 feet East of the center line, of McCord Street, in the City of Benton Harbor, thence South 123.5 feet, thence East 39.44 feet, thence North 123.5 feet to the South line of Buss Avenue, thence West 39.44 feet to the place of beginning, which now purports to be Lot 18, Assessor’s Hadlow Plat, according to the plat thereof, recorded 08-20-32, in Volume 9 of Plats, Page 26.
The redemption period shall be 6 months from the date of such sale, unless determined abandoned in accordance with MCLA §600.3241a, in which case the redemption period shall be 30 days from the date of such sale.
If the property is sold at foreclosure sale, pursuant to MCL 600.3278, the borrower will be held responsible to the person who buys the property at the mortgage foreclosure sale or to the mortgage holder for damage to the property during the redemption period.
