TOWNSHIP OF GALIEN COUNTY OF BERRIEN, STATE OF MICHIGAN

                                                                                                                                                              An Ordinance to amend the provisions of Ordinance No. 2-B, “An Ordinance to Amend Galien Township Ordinance No. 2, Being the Galien Township Litter and Debris Ordinance”, to define penalties and for the enforcement thereof.

 

THE TOWNSHIP OF GALIEN ORDAINS:

SECTION ONE. Section IV of Galien Township Ordinance No. 2-B “An Ordinance to Amend Galien Township Ordinance No. 2, Being the Galien Township Litter and Debris Ordinance”, is deleted in its entirety, with the following paragraphs inserted in its place and stead:

The Township Board hereby designates the Township Code Enforcer to enforce the provisions of this Ordinance.  It shall be the duty of said Code Enforcer to investigate all complaints under this Ordinance, and to send notices of violation to the owner, lessee, tenant or occupant of the property by mailing a copy of a violation notice to the last known address by first class mail, or by hand delivery.

Any person, firm or corporation that violates any of the provisions of this Ordinance shall be guilty of a municipal civil infraction, and shall be ordered by the court to bring the property in compliance with the ordinance in a reasonable amount of time, and shall also be punished by a fine of $150.00 for a first offense, and  up to $500.00 for subsequent offenses. If the property is not cleaned up in the time provided by the Court, the Court shall enter an order allowing the Township to enter upon the property and complete clean up of the property by the Township. The Township shall thereafter have the authority to put the costs of cleanup on the next property tax bill for the parcel on which the cleanup occurs.  Each day that a violation continues to exist shall constitute a separate offense.
