NOTICE OF ADOPTION:
ORDINANCE AMENDING WATER ORDINANCE (ORDINANCE NO. 13) AND SEWER ORDINANCE (ORDINANCE NO. 14)
To the residents and property owners of the Township of Buchanan, Berrien County, Michigan, and all other interested persons:
On July 19, 2018, the Township of Buchanan (the “Township”) adopted an Ordinance No. 115-2018, Ordinance Amending Water Ordinance (Ordinance No. 13) and Sewer Ordinance (Ordinance No. 14) (“Ordinance”). A summary of the Ordinance is provided below. A true copy of the Ordinance, including any exhibits, is available for inspection at the Township Office, 15235 Main Street, Buchanan, MI 49107 during regular business hours.
Section 1. This section amends Section 4 of Ordinance No. 13 (as amended) entitled “Rates” for water service to add an annual replacement surcharge that will be billed and payable in monthly installments.
Section 2. This section amends Section X of Ordinance No. 14 (as amended) entitled “Charges and Rates for Use of System” for sewer service to add an annual replacement surcharge that will be billed and payable in monthly installments.
Section 3. This section provides that if any portion of the Ordinance is found invalid for any reason, such holding shall not be construed as affecting the validity of the remaining portions of the Ordinance.
Section 4. This section provides that if any ordinances or parts of ordinances in conflict herewith are hereby repealed only to the extent necessary to give the Ordinance full force and effect.
Section 5. This section provides that the Ordinance shall take effect immediately following publication.
